Copyright and Infringement Policy

Scope and Applicability

This Policy applies to all users accessing, uploading, creating, sharing or interacting with the content on our mobile app/ website (“Platform”).

Intellectual Property Rights

All the content on Lokal App is user-generated content, created, submitted and uploaded by the users of the Platform.

The users of the Platform website are and at all time shall be governed by and subject to the laws regarding copyright, trademark, patent and trade secret ownership and use of intellectual property. You agree to abide by laws regarding copyright, trademark, patent and trade secret ownership and use of intellectual property and you shall be solely responsible for any violations of any laws and for any infringements of any intellectual property rights caused by your use of the mobile app/website through your device.

The use of the third-party copyrighted work without consent of the owner of the copyrighted work is strictly prohibited. You shall be solely responsible for any violations of any laws and for any infringements of any intellectual property rights caused by your use of the mobile app/website through your device.

Takedown Procedures (Notice of Infringement)

If you are a copyright owner, or an authorised representative acting on behalf of a copyright owner, and you believe that any content available through Lokal App infringes your copyrighted work, you may submit a formal notice of infringement. This notice allows Lokal App to review the claim and take appropriate actions wherever necessary.

To help Lokal App to process your request efficiently, the takedown notice should include the following information:

1. Identification of the copyrighted work: Provide a clear description of the copyrighted material/s that you claim has been infringed.
2. Location of the infringing content: Specify the exact location of the allegedly infringing material within the Platform. This may include a direct URL that allows us to locate the content quickly.
3. Statement of ownership or authorization: A statement affirming and confirming that you are the copyright owner or are authorized to act on behalf of the copyright owner of the material in question.
4. Contact information: Provide sufficient contact details so that Lokal App can communicate regarding the infringement claim, including: Full name, mailing address, phone number & email address.
5. Accuracy & good-faith declaration: Self-declaration statement that the information provided in the infringement notice is accurate and that there is a good faith belief that the disputed use of the material in question is not authorised by the copyright owner or its agent.
6. Signature: A physical or electronic signature of the copyright owner or the person authorised to act on its behalf.

Counter-Notice Procedure

If you believe that your content was removed or disabled due to a mistake or misidentification following a copyright infringement claim, you may submit a Counter-Notice requesting that the content be reviewed and potentially restored.

To ensure proper review, your counter-notice must include the following details:

1. Identification of removed content: Provide a clear description or reference to the content that was removed or disabled so that Lokal App can identify it.
2. Contact information: Provide sufficient contact details so that Lokal App can communicate regarding the disputed claim, including: Full name, mailing address, phone number & email address.
3. Consent to jurisdiction: A statement confirming that you consent to the jurisdiction of the competent courts located in Bengaluru, India, and that you agree to accept service of legal process from the person who submitted the original infringement notice or their authorised representative.
4. Accuracy & good-faith declaration: Self-declaration statement that the information provided in the counter notice is accurate and that there is a good faith belief that the content was removed or disabled as a result of a mistake or misidentification.
5. Signature: A physical or electronic signature of the copyright owner or the person authorised to act on its behalf.

Lokal App shall review the content of the counter notice and shall forward the same to the original complainant where appropriate and shall proceed in accordance with law.

Repeat Infringer Policy

Lokal App takes intellectual property rights seriously and maintains internal procedures to address repeated violations and ensure compliance with applicable laws.

Users who repeatedly submit or share content that infringes on the intellectual property rights of others may be subject to enforcement actions. Depending on the severity and frequency of violations, Lokal App may take one or more of the following measures:

• Temporary Account Suspension: Restricting access to certain or all platform features for a specified period.
• Permanent Account Termination: Permanently disabling the user’s account in cases of repeated or serious copyright violations.
• Reporting to Relevant Authorities: In situations where infringement activity involves serious or unlawful conduct, Lokal App reserves the right to report the matter to appropriate legal or enforcement authorities in accordance with applicable laws and regulations.
• Maintenance of Takedown Records: Lokal App maintains internal records and logs of all takedown notices and counter-notices received, to monitor patterns of infringement activity, track repeat violations by users, and ensure transparency and consistency in enforcement actions. Maintaining these logs helps Lokal App evaluate user behaviour over time and take appropriate action when necessary.

These actions are taken at Lokal App’s discretion after reviewing infringement reports and user activity.

No Automated Filtering Obligation

Lokal App strives to maintain a safe and compliant Platform for its users. However, due to the volume and nature of user-generated content, the Platform is not obligated to actively monitor, review, or filter all content uploaded, shared, or posted by users.

• No General Monitoring Obligation: Lokal App does not undertake a general duty to pre-screen or continuously monitor every piece of content submitted by users on the platform. Responsibility for ensuring that uploaded content complies with applicable laws and intellectual property rights primarily rests with the users who post such content.
• Use of Moderation Tools: While continuous monitoring is not guaranteed, Lokal App may implement automated systems, moderation tools, or manual review processes where feasible to help detect, manage, or address potentially infringing or inappropriate content.
• Discretionary Enforcement: Lokal App reserves the right, at its sole discretion, to review, remove, restrict access to, or take action against content that may violate its policies, applicable laws, or the rights of third parties. These measures are intended to support responsible platform usage while balancing operational feasibility and user participation.

Limitation of Liability

The limitation of the liability applies regardless of the legal theory on which the claim is based, including warranty, contract, tort or otherwise and regardless of whether Lokal App has been advised of the possibility of such damages.

By using the mobile app/website and availing the Services thereof, you waive any and all claims against us. Some states may not allow the exclusion or limitation of implied warranties or certain types of damages, so these provisions may not apply to you.

The limitation of liability is an essential part of the present agreement and represents a fair distribution of risk. The mobile app/website and Platform would not be provided without these limitations and you agree that they survive the termination of your Account and/or access to the Service of the mobile app and/ or Platform. This disclaimer does not affect liability for fraud, fraudulent misrepresentation or other liability that cannot be limited under applicable law.

Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of India. The Courts of Bangalore, Karnataka shall have the exclusive jurisdiction over any disputes arising under these Terms & Conditions and Platform Policies.

You and Lokal App (Parties) agree and consent to first mediate any disputes or claims between us in good faith and resolve the disputes amicably.

You agree and consent that you will not file or participate in a class action against us.
